Judge under fire after child rapist gets just one year
A sixty-four-year-old who molested, raped and sodomized a four-year-old girl will serve just one year in jail, CNN reports.
Though he was originally sentenced to twenty years, he later had the majority of his sentence revoked as part of a plea deal.
“Some people think I could have given a different sentence, and I couldn’t,” District Judge Thomas Bartheld claimed in his defense. “In any plea bargain, where there is a negotiated plea, the court can’t change it.”
The judge is catching some heat for this case.
The Pryor Daily Times reports, “Oklahoma’s attorney general wants to know why a man who admitted to raping a McAlester girl did not also face charges for abusing her older brother. Two state legislators are separately calling for the removal of the judge who oversaw the controversial plea agreement that gave David Earls just one year in jail.”..................
