New Policy Permits Asylum for Battered Women

The Obama administration has opened the way for foreign women who are victims of severe domestic beatings and sexual abuse to receive asylum in the United States. The action reverses a Bush administration stance in a protracted and passionate legal battle over the possibilities for battered women to become refugees. In addition to meeting other strict conditions for asylum, abused women will need to show that they are treated by their abuser as subordinates and little better than property, according to an immigration court filing by the administration, and that domestic abuse is widely tolerated in their country. They must show that they could not find protection from institutions at home or by moving to another place within their own country.........

i wanted to post this particular story because it was a couple of thousand miles away. i wanted to post it because it was a tragedy. i wanted to post it because it could have (AND SHOULD HAVE) been prevented.

i wanted to post it because this happens in every state and it happens far too often (this morning i read about a man in connecticut beating up his pregnant girlfriend. nice, huh)

there have been a lot of incidents of domestic violence in connecticut of late. two within the past few weeks. one woman died, the other escaped.

we need better protection and we need better laws.

Kristin Maxwell's Lonely Death

Friday, July 10, 2009 | After San Diego County sheriff's Deputy Lowell "Sam" Bruce shot his wife in the face in front of their 4-year-old son, Kristin Marie Maxwell-Bruce was able to walk to the kitchen phone and dial 911.

As she waited for medical help on that December evening in 2006, Kristin was alert and talking -- but it was with some difficulty because the bullet had destroyed half her tongue and the left side of her jaw.

She told her mother she was worried about her teeth; her mother assured her they could be fixed. Upon arrival at the Alpine home, medics found that Kristin's vital signs -- pulse, body temperature, blood pressure and respiratory rate -- were within normal range.

But Kristin's family claims a shocking series of blunders and delays by Sheriff's investigators and medics resulted in a lonely and unnecessary death an hour later for the 38-year-old mother of two.

The evening was capped by a violent encounter between deputies and Kristin's distraught father -- a sequestered witness who was pepper-sprayed, clubbed and handcuffed when he tried to leave sheriff's custody to tell his wife that their only child was dead, according to the wrongful-death lawsuit filed in December 2007 by Kristin's parents, Jim and Kay Maxwell.......

The billboard works by scanning its proximity with an eye-tracking camera, which triggers an image switch on the display panel when it senses someone looking at it. The change only occurs after a brief delay, so that observers understand what's going on, and get the message..................

Iraqi women 'lack basic services'
Women in Iraq still lack security and basic services, despite an overall drop in violence six years after the US-led invasion, aid agency Oxfam says.

Reporting on a survey of about 1,700 women in five provinces taken last year, Oxfam described their plight as a "silent emergency".

It suggested more than half the women had suffered from violence.

A quarter did not have daily access to water supplies, and more than three-quarters were not getting pensions.

Last month, Iraq's minister for women resigned, saying the government was not taking the plight of women seriously.

Oxfam said: "Iraqi women are suffering a silent emergency', trapped in a downward spiral of poverty, desperation and personal insecurity despite an overall decrease in violence in the country."

The survey, released to mark International Women's Day, suggested that more than 20% of widows had been victims of domestic violence. ...........

IT MUST STOP

Ron Reagan has had enough of loudmouth Rush Limbaugh spreading his lies and socially-backwards innuendo. Last week the bloviator of the golden microphone went too far while discussing the gruesome case of Muzzammil Hassan, who beheaded his wife in what was deemed an "honor killing."

Rush's response to that was inane:

That N.O.W. gang is out there saying "Ah now that’s not domestic violence, that’s just uh, that’s just uh, what'd they call it, “culturally honor killing” and this woman was gonna divorce him…it’s against the law, and, and, and, that's that's…that's his diversity."

Ron Reagan noticed this absurdity and had Kim Gandy, the President of the National Organization for Women, on his show to ask her if the organization truly does believe that this killing was not domestic violence. Gandy responded by saying, "That is an absolute outrage. Any violence against women is one of our top priorities." ..............

this is NOT good

young girls thinking it's OK for a woman to be battered by her partner. there is NOTHING that can justify domestic violence (there are cases where it's woman on man, but that is rare indeed)

Many teens blame Rihanna, say dating violence normal
1 in 10 teens suffer abuse in romantic relationships, and many think it's often justified

Ed Loos, a junior at Lake Forest High School, said a common reaction among students to Chris Brown's alleged attack on Rihanna goes something like this: "Ha! She probably did something to provoke it."

In Chicago, Sullivan High School sophomore Adeola Matanmi has heard the same.

"People said, 'I would have punched her around too,' " Matanmi said. "And these were girls!"

As allegations of battery swirl around the famous couple, experts on domestic violence say the response from teenagers just a few years younger shows the desperate need to educate this age group about dating violence. Their acceptance, or even approval, of abuse in romantic relationships is not a universal reaction. But it comes at a time when 1 in 10 teenagers has suffered such abuse and females ages 16 to 24 experience the highest rates of any age group, research shows.

In recent years, some schools and youth organizations have started educating teens about the dangers of dating violence. Rhode Island and Virginia have adopted laws requiring such instruction in the public schools.....................

The actor, who co-starred in "Iron Man" and was nominated in 2006 for an Academy Award for his role in "Hustle & Flow," was arrested by Pennsylvania cops in September 2001 for assaulting his estranged wife. According to a Whitemarsh Police Department report, after Howard and Lori McCommas argued on the phone, the actor warned, "Don't disrespect me by hanging up on me or I'll come over and hurt you.".................

Justice Scalia: Domestic Violence is "not that serious an offense"
Dahlia Lithwick at the XX Factor highlights the assholedom that is Supreme Court Justice Antonin Scalia, who thinks violence against women is "not that serious an offense."

Yesterday the Supreme Court heard a case about the reach of the Federal Gun Control Act and whether it includes someone convicted of misdemeanor domestic violence.

...Courtesy of the LA Times' David Savage, here's a report of oral argument, which evidently went poorly for the proponents of disarming wife beaters. Of note in the transcript is the following exchange between Justice Antonin Scalia and Nicole Saharsky, the Justice Department lawyer arguing for the stricter interpretation of the law.

JUSTICE SCALIA: And this was misdemeanor assault and battery, wasn't it?

MS. SAHARSKY: Yes, that's right. I mean, I really--

JUSTICE SCALIA: So it's not that serious an offense. That's why we call it a misdemeanor.

MS. SAHARSKY: Well, I mean, certainly the offense is this particular case was serious. The charging document reflects that Respondent hit his wife all around the face until it swelled out, kicked her all around her body, kicked here in the ribs--.................

It's not a "Facebook crime," it's domestic violence

I don't care if you call it domestic violence or intimate partner violence - but stop calling it a Facebook crime, or a MySpace murder. It has nothing to do with social networking and everything to do with violence against women.

Take this latest story from the BBC:

A man has been jailed for life for stabbing his wife to death over a posting she made on the social networking site Facebook.

Wayne Forrester, 34, told police he was devastated that his wife Emma, also 34, had changed her online profile to "single" days after he had moved out.

Forrester did not murder his wife because of her Facebook status, he murdered her because he was an abuser.

The couple, who had been together for 15 years, had a "volatile" marriage, jurors were told..............

he acquitted a man who hit his girlfriend THREE TIMES IN THE FACE (this took place in public in a parking lot). how did the judge know he hit her three times? there was a witness. who was the witness? an off duty POLICE officer. IMPARTIAL POLICE OFFICER at that.

the victim didn't show up at the hearing so the judge decided she may have WANTED TO BE HIT (he mentioned in s&m or b&d that COULD be the case. oh, someday, i'm going to talk a bit more about THAT. i have a few things to say on that subject and some background to say it). ah, but we ALL know (all of us but the judge) how AFRAID victims of domestic abuse are. we also know how many are beaten to within an inch of their very lives OR KILLED because they either tried to get away from the abuser or had the abuser arrested.

Maryland Judge: Some Domestic Violence Victims Like Being Hit

Domestic violence cases are notoriously difficult to prosecute.
But every once in a while, prosecutors get handed the tools for a conviction on a silver platter: An impartial eyewitness who just happens to be a police officer.
Such was the case in a domestic violence trial that made the local papers here in Maryland last week. A cop pulling into an Exxon station saw a man hit his girlfriend in the face three times, called in back-up and had the man arrested.
But according to Anne Arundel County Circuit Judge Paul Harris, who is "probably as against domestic violence as anybody, when the case is proven," one can't simply assume that a woman who is being hit didn't consent to the attack. "Sadomasochists sometimes like to get beat up," the judge reminded the courtroom--then acquitted the man. .........

michael webb is the acquitted WOMAN BEATERs name. he got let off of that, but according to a video at alternet recounting this story, the acquitted WOMAN BEATER michael webb is doin' time for a drug violation. well, he sounds like one stand up kinda dude!

Here's an interesting video that I grabbed from Echidne. Warning: It's really distressing -- in part, it's a video a man made his son take of him beating his wife. What's fascinating is it really shows how justified abusers feel about their behavior. The end part is interesting, too, since they interview the judge on this case.
